Early today, the Federal High Court sitting in Yenagoa gave another order for substituted service by hanging the Court Processes flied Distinguished Senator Moses Cleopas challenging the ELIGIBILITY of Rt. Hon. Kombowei Benson Friday the immediate past SSG of Bayelsa State.
The second order today became necessary as counsel to the Defendant the immediate past SSG Rt Hon. Kombowei Benson Friday raised objection of “proper service” on his client stating that the said process was only given to a domestic staff and for the interest of justice and fairness, the Federal High Court Yenagoa gave another order immediately for another service via substituted means specifically hanging the process on the gate of the former SSG and PDP Bayelsa Central senatorial candidate. The court also ordered that the bailiff show prove of service by hanging on the gate, snapping and printing which was done immediately in line with the order.
The suit challenging Rt. Hon Kombowei Benson Friday eligibility for the Bayelsa Central senatorial election was brought or filed by Distinguished Senator Moses Cleopas the current Bayelsa Central Senator. The suit is filled by Originating summons section 29 (5) of the Electoral Act,2022.
The four (4) grounds for seeking the former SSG’s disqualification are ;
1. First School Leaving Certificate ( FSLC) Forgery/ given false information in PDP Expression of Interest/Nomination Form.
2. National Youth Service Corps(NYSC) Exemption certificate forgery/ given false information in PDP Expression of Interest/ Nomination Form.
3. Failure to sign his Expression of Interest form before a commissioner for oath to authenticate the information imputed in the PDP Expression of Interest form.
4. Lied on oath that he has not been tried in any competent Court of law..
Attempts by the defence lawyer to take a long adjournment was overruled by the court and the cases is slatted on the 3rd of August, 2022 for definite heading.
